Phase I & Phase II Environmental Site Assessments (ESA)

APEC conducts ESAs using the ASTM Standard E-1527-13: (Standard Practice of Environmental Site Assessments: Phase I Environmental Site Assessment Process) to assist our clients in due diligence assessments of property transactions or development projects necessary for the “innocent landowner” defense under CERCLA.

Our Phase II ESAs are conducted using the ASTM Standard E-1903-11: (Environmental Site Assessments: Phase II Environmental Site Assessment Process) after Recognized Environmental Conditions (RECs) are identified from the Phase I ESA.

Asbestos Inspection & Mitigation

APEC’s staff is Environmental Protection Agency (EPA) accredited/licensed.

Subsurface Investigations

APEC conducts Subsurface Investigations for facilities and properties to determine if contamination from chemicals or otherhazardous substances derived from petroleum products, landfills, hazardous materials storage facilities, dry cleaners, and industrial facilities have been spilled or released onto the property. As part of the investigation, the horizontal and vertical extents, and levels of contamination are determined to assist the owner/buyer on the next steps for remediation. These investigations have involved drilling thousands of borings and the installation of groundwater monitoring wells in both unconsolidated material and bedrock. Karst Investigation

Karst is a topography formed from the dissolution of soluble rocks such as limestone, dolomite, and gypsum. The land above karst features can be very unstable and dangerous. Most people think of sinkholes or caves with karst. However, there are many other features associated with karst topography that need to be investigated. APEC’s team of professional geologists and geotechnical engineers have karst experience across the US to investigate and mitigate any karst terrain where your project may be located.

Brownfields Site Assessments & Redevelopment Plans

An environmentally distressed property or “Brownfield” is a problem for the entire community. By utilizing a “recycling” approach to redeveloping Brownfields, APEC can identify redevelopment opportunities where viable buildings and infrastructure are already present. Redevelopment of Brownfields properties in this way quickly benefits communities by rejuvenating vacant buildings, increasing the tax base and reducing blight.
APEC provides a turnkey approach to Brownfield Redevelopment. In addition to providing services for State and Federal grant application processing and management, the team addresses potential regulatory compliance issues, environmental assessment requirements, and project specific remediation and closure guidance.

Insurance Cost Recovery

APEC assists our Clients in accessing historical Commercial General Liability (CGL) insurance to fund the remediation of contaminated properties and to satisfy related liability that can be associated with these properties. APEC and our network of attorneys have worked on many projects where the Buyer purchased a contaminated piece of property and used historical insurance coverage to cover costs to remediate the property benefiting both the seller and the buyer.

Underground Storage Tank (UST) Closure & Reporting

APEC provides turnkey operations for Underground Storage Tank (UST) and Aboveground Storage Tank (AST) removal and closure services. Our staff have managed and conducted UST removals for a variety of industrial and public sector clients. UST removal projects involve removing tanks, conducting interim remedial activities, and submitting UST closure reports to regulatory agencies.

Our UST closure services include in-house state certified personnel for excavation, tank interior cleaning, and tank removal.

Natural Resource Assessments

APEC provides a range of natural resource assessment consulting services including wetland delineation, permitting, mitigation and endangered species evaluation services for our clients. Our team of professionals are recognized leaders in the business that include professionals educated in the fields of environmental scientists, engineers, ecologists, wetland specialists, wildlife biologists, and hydrologists.

Spill Prevention Control & Countermeasure (SPCC) Plans

EPA regulations 40 CFR 112.3 for Spill Prevention Control and Countermeasure (SPCC) plans are used to prevent oil or chemicals from entering navigable waters through the prevention, control, and mitigation of spills. APEC provides SPCC plans for small bulk storage facilities to large industrial facilities that store chermicals, oil, and oil-containing products exceeding EPA thresholds. APEC’s SPCC plans are certified by a licensed engineer and address the following: ⦁ Operating procedures to prevent spills, ⦁ Control measures to prevent a spill from reaching navigable waters, and ⦁ Countermeasures to contain, clean up, and mitigate the effects of a spill that may reach navigable waters.

Corrective Action & Remedial Work Plans

APEC prepares Corrective Action Plans (CAP) and Remedial Work Plans (RWP) based on site investigation data, physical characteristics of the contaminants and the evaluation of the potential migration and breakdown capabilities of the contaminants. The CAP/RWP includes the assessment of the toxicological affects upon the human health and the environment, and includes an evaluation of available remediation options and their cost-effectiveness that would be suitable for the subject property.

Hazardous Material Spill Cleanup Management & Reporting

APEC provides cost effective and efficient operations for hazardous material spill cleanups and emergency response management. The method of cleanup is site dependent on the type of material release, the media to which the release occurred, the quantity of the material spilled, and other site dependent variables. APEC will manage the spill cleanup and act as a liaison between the client, state/federal representatives, and local authorities to ensure the cleanup is conducted and approved by the proper agents involved.

Litigation Support

APEC understands environmental regulations and noncompliance issues, and has helped our clients with agency determined penalties for different types of legal proceedings and agreed orders. Our staff is prepared to provide expert witnesses in the fields of geology, contaminant evaluation, and engineering to provide expert testimony when needed.

NPDES Construction & Discharge Permitting, Sampling & Management

The NPDES permit program addresses water pollution by regulating point sources that discharge pollutants to waters of the United States. Created in 1972 by the Clean Water Act, the NPDES permit program is authorized to state governments by EPA to perform many permitting, administrative, and enforcement aspects of the program. APEC has conducted NPDES permit audits, prepared permits, and conducted sampling to comply with state and EPA regulated NPDES permits.

Storm Water Pollution Prevention Plans (SWPPP)

APEC ensures compliance with the National Pollution Discharge Elimination System (NPDES) industrial stormwater permitting program by writing Storm Water Pollution Prevention Plans (SWPPP) that implement all local, state, and federal regulatory requirements. This includes submission of Notice of Intent (NOI), Discharge Monitoring Reports (DMRs), and Annual Reports. APEC also assists with visual monitoring requirements, non-stormwater discharge assessments, discharge sample collection, laboratory analysis, inspections, and implementation of Best Management Practices (BMPs).

INDOT Prequalification
